Terms and conditions
These terms are the agreement between you and Pasión del Oeste Editorial LLC (“we,” “us,” “the publisher”) when you use pasiondeloeste.com or buy any of our publications. We wrote them in plain English on purpose: we want them understood, not skipped.
By buying or downloading anything from this site, you agree to what's below. If something here doesn't sit right with you, don't buy — write to us instead.
1. You have to be an adult
Pasión del Oeste is an adult publication: it contains sensuality, western-genre violence and barroom language. By buying, you represent that you are 18 or older and that the law where you live permits you to acquire this material. We do not sell to minors under any circumstances.
2. What you're actually buying
When you buy a digital issue, you're buying a personal reading license, not ownership of the work. The license is perpetual, non-exclusive and non-transferable, and it lets you:
- Download the file and keep it on as many devices as you want, as long as they're yours.
- Read it as many times as you like, offline, with no time limit.
- Print one copy for your own use.
- Hand your device or your copy to family and close friends, the way the magazine always got passed around.
What the license does not let you do
- Resell, rent, auction it, or include it in any paid bundle.
- Upload it to download sites, file-sharing networks, mass messaging channels, digital libraries or public storage services.
- Distribute it to a mailing list, an open group or an online community.
- Modify, translate or create derivative works without our written permission.
- Use the file, its images or its text to train, fine-tune or feed artificial intelligence systems, or to generate content with them.
Lending it to your buddy is fine. Uploading it to a group of a thousand people is not. We will be firm about the second one.
3. The files have no lock, but they do carry your name
We don't use DRM: the file opens in whatever reader you want, with no permissions and no connection required. In exchange, files may carry the email address used to purchase them, stamped into them. If a file with your email shows up circulating online, we may cancel your license and block future purchases.
4. The subscription
- It costs $3.99 USD per month and renews on its own every month until you cancel.
- Every month we send a new issue to the email address you subscribed with.
- You cancel it yourself from the link in every email — no phone call, no explanation.
- When you cancel, the subscription stays active through the end of the period you already paid for.
- Issues you already downloaded are yours forever, even after you cancel.
- If we change the price, we'll email you at least 30 days in advance. The new price applies at your next renewal, and if you don't like it, cancel before then and you won't be charged.
5. Payments and taxes
Payments are processed by Payhip together with Stripe and PayPal. We never see or store your card details. Payhip acts as a marketplace facilitator in the United States and Canada, so any applicable sales tax is calculated and remitted through them. Prices are in US dollars; if your bank charges a currency conversion fee, that fee is yours, not ours.
6. Refunds
Digital editions are non-refundable, because they're delivered instantly and can't be returned. Print editions can be returned. The exceptions, the deadlines and the process are in our refund policy, which is part of these terms.
7. This is all fiction
The characters, towns, events and dialogue in Pasión del Oeste are invented. Any resemblance to real people, living or dead, or to actual events, is pure coincidence. The work depicts violence and conduct we neither endorse nor recommend: it's a western, not a manual.
8. Intellectual property
The stories, scripts, illustrations, characters, logos and the design of this site are the property of Pasión del Oeste Editorial LLC or used under license. Buying an issue does not transfer any of those rights to you.
9. The site is offered “as is”
We do our best to keep the site and the downloads working, but we can't promise they'll never go down or that they're free of errors. We're also not responsible for failures of your device, your connection, your e-reader or third-party services.
10. Limitation of liability
To the extent the law allows, our total liability to you for any claim related to this site or our publications is limited to the amount you paid us in the preceding twelve months. We're not liable for indirect or incidental damages or lost profits. None of this limits liabilities that by law cannot be limited.
11. Account termination
We may suspend or terminate access for anyone who distributes our files, files fraudulent chargebacks, or uses the site for anything unlawful. In those cases, there is no refund.
12. Governing law
These terms are governed by the laws of the State of [STATE OF LLC FORMATION], United States of America, without regard to its conflict-of-laws rules. Any dispute will be resolved before the competent courts of [CITY AND STATE]. If you are a consumer and the law where you live grants you rights that cannot be waived, those rights are respected.
13. Changes to these terms
We may update them. When we do, we change the date at the top, and if the change is significant we'll email you. The version that applies to your purchase is the one published on the day you bought.
